THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.20825 of 2010 AND C.C.NO.90 OF 2011 COMMON ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeks the following relief:

"to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents in insisting the petitioner to vacate from her land of Ac.4-08 cents covered by survey number 129/1 of Paradesipalem Village, Visakhapatnam Rural Mandal, Visakhapatnam District as illegal, irregular, irrational, without jurisdiction, discriminatory, violative of principles of natural justice, provisions of Andha Pradesh Urban Area (Development) Act, 1975 and offends articles 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to dispossess the petitioner from the said land"

Heard Sri Seetharam Chaparla, learned counsel for the petitioner and Sri P. Jagadesh Chandra Prasad, learned Standing Counsel for the first respondent - Visakhapatnam Urban Development Authority.

This Court, while issuing rule nisi on 23-08-2010, granted interim order in W.P.M.P.No.26474 of 2010, directing the respondents not to dispossess the petitioner from the land in question without following due process of law. Today, when the matter is taken up for hearing, it is

submitted by the learned Standing Counsel for the first respondent - Urban Development Authority that pending this writ petition two representations were submitted on behalf of the petitioner herein on 21-08-2014 and 09-02-2015, requesting the first respondent - Urban Development Authority to grant compensation either in the form of market value of the land as per the provisions of Land Acquisition Act or in the form of TDR @ 200% of the land cost and the copies of the said representations have been placed on record by the learned Standing Counsel. It is also stated by the learned Standing Counsel that there is no dispute with regard to the title of the property.

In view of the above development pending writ petition, the writ petition is disposed of, directing the respondents herein to take appropriate action on the representations, dated 21-08-2014 and 09-02-2015 submitted on behalf of the petitioner herein within a period of four (4) months from the date of receipt of a copy of this order.

In view of the orders passed in writ petition No.20825 of 2010 the contempt case stands closed. The respondent stands discharged. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in the Writ Petition and Contempt Case shall stand closed. ___________________ A.V. SESHA SAI, J February 23, 2015 PN
