Northern Power Distribution Company Ltd, Karimnagar local and district ...RE''.NDENTS Petition under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in issuing the call letter list without furnishing the details of marks awarded to each candidate, which formed the basis for selection of the candidates and not displaying the names of the petitioners in the call letter list at the Sub-Section Karimnagar Division, enabling them to attend the pole climbing test schedule to be held on 17.O2.2O14 or 18 02.

2O14 or any subsequent date, though the petitioners are fully eligible, suitable and qualrfied to be appointed the post of operators on contract basis, pursuant in the Annexure P-2 notification, belonging to same village and Mandal, as arbitrary, illegal, against the principles of natural justice and violates the Article '14 & 16 of the constitution of lndia and consequently direct the respondents to consider the case of the petitioners for appointment to the posts of operators contract basis, by permitting them to appear for the pole climbing test schedule to be held on 17.O2.2O14 ot 18.02.

{ { Today when the matter has been taken up for hearing, none appeared for the petitioners.

Learned counsel for the respondents has drawn attention of this Court to the order dated 17.02.2014 which reads as under: "Notice before admission. The petitioners claim that they have submitted applications for the post of operators pursuant to the Notification issued by the respondents. Subject to verification of the same, the respondents shall permit the petitioners to participate in the pole climbing test only. Post after two weeks." 2.

Subsequent order dated 17.O2.2OL4, respondent authorities have filed vacate petition to vacate interim order dated L7.02.2014 and para 4 reads as under:

"Pursuant to the above, the petitioners were permitted to participate in the interview held 15.02.2014 and 17.02.2014. Thus the orders of the Hon'ble High Court of A.P have been scrupulously followed. But, the petitioners have failed to come on time for the pole climbing test on ly. "

Learned counsel appearing for the respondents further submits that since the respondents have failed to come on time for the pole climbing test and cause in the writ petition does not survive and prays this Court to dismiss the writ petition. Accordingly, this Writ Petition is dismissed.
