HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.22799 of 2015 ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) In this writ petition, the petitioner has questioned the eauction notice dated 22.06.2015 issued in exercise of powers under Rules 6 (2) & 8(6) of the Security Interest (Enforcement) Rules, framed under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, as per which the auction was to be held on 31.07.2015.

When the matter is called for hearing, it is submitted by Sri Ambadipudi Satyanarayana, learned counsel appearing for the respondent Bank, that while the father of the petitioner has two accounts, the petitioner has one account with the respondent Bank. After issuing e-auction notice, the father of the petitioner has made a representation and also paid an amount of Rs.2,00,000/- in his accounts and also in the account of the petitioner. It is also submitted that in view of the request made by the father of the petitioner, the auction was not conducted on 31.07.2015 and his accounts were closed.

Inasmuch as no auction was conducted pursuant to e-auction notice dated 22.06.2015, the subject matter of the writ petition has become infructuous and no relief as prayed for can be granted.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
