The revision arises out of the dismissal of an application under Order VII Rule 11 C.P.C.
2. Heard Mr. Srinivasa Rao Velivela, learned counsel for the petitioner.
3. The main suit was for recovery of possession and for damages. The petitioner, who was the defendant, took out an application under Order VII Rule 11 to reject the plaint on the ground that the Court lacked pecuniary jurisdiction. The said application was rejected, rightly so, by the Court below upon perusing the nature of the relief sought. Once the nature of the relief sought indicates that the value is within the jurisdiction of the Court, any dispute with reference to valuation should be taken up during the trial. Therefore, the trial Court is right in dismissing the petition. Hence the Civil Revision Petition is dismissed.
4. As a sequel, miscellaneous petitions pending in this revision petition, if any, shall stand closed. There shall be no order as to costs. ______________________________ JUSTI CE V. RAMASUBRAMANI AN 7th July, 2017 Js.
