HONOURABLE SRI J USTICE SURESH K UMAR K AIT CRIMINAL PETITION No. 15412 of 2016 ORDER:

Vide present Criminal Petition, the petitioner/Accused No.3 seeks bail in anticipation of his arrest in connection with Crime No.168 of 2015 registered on the file of Station House Officer, Police Station, Anaparthi, EG District for the offences punishable under Sections 420,468,471 read with Section 34 IPC. Learned Counsel appearing on behalf of the petitioner argued that when the bank officials sought for valuation report from the petitioner in respect of the property offered as security for the proposed advance to be made, certain property documents were handed over to the petitioner to enable him to furnish the valuation report based on the duly approved layout and the registered sale deed bearing No.985/2011.

In regard thereto, the petitioner had inspected the schedule property and basing upon the documents, he had submitted valuation report dated 3.5.2011. Learned Additional Public Prosecutor appearing on behalf of the respondent-State submits that the duty of the valuer is to give valuation report in a specified format after physical inspection of the assets/property.

In view of the aforesaid submissions of the learned Additional Public Prosecutor, and since the custodial interrogation of the petitioner is required, I am not inclined to grant bail. At this stage, learned Counsel for the petitioner/Accused No.3 sought permission to withdraw the Criminal Petition, which is declined.

The Criminal Petition is dismissed.
