ORDER:
This Writ Petition is filed for a mandamus to set-aside order in proceedings Rc.No.K4/PKD/125/2009, dated 2-2-2009 of respondent No.1 whereby he has stayed the order in proceedings Rc.No.1985/2008/C, dated 5-1-2009 of respondent No.2 appointing the petitioner as a temporary fair price shop dealer. At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP) submitted that during the pendency of this Writ Petition, the petitioner has given up her temporary dealership and that at present she is not functioning as the dealer. This submission is not disputed by the learned Counsel for the petitioner. In the light of this submission coupled with the fact that the order
impugned in this Writ Petition is only interim in nature pending appeal before respondent No.1, adjudication of this Writ Petition on merits is not necessary. However, if the petitioner is still interested in the temporary dealership, she is left free to pursue the appeal before respondent No.1.
Subject to the liberty given to the petitioner as above, the Writ Petition is dismissed.
