HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 5898 of 2016 ORDER:

The petitioner complains inaction of second and third respondents in considering and disposing of representation dated 13.12.2015 preventing the fourth respondent from encroaching panchayat road and removing the encroachments as illegal and unconstitutional.

Having regard to the nature of prayer sought for, the Writ Petition can be disposed of with the following order. The petitioner is given liberty to communicate a copy of this order along with representation dated 13.12.2015 to second and third respondents within one week from today and second and third respondents are directed to enquire into the allegations made against the fourth respondent, if necessary conduct an enquiry and take appropriate action in

accordance with law within a further period of four weeks thereafter.

Subject to the above, the Writ Petition is disposed of at the admission stage.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
