HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6881 of 2017 ORDER:

Heard learned counsel for the petitioners/ accused, who are saying they are going to be implicated as co-accused in Crime No.191 of 2017 of Huzurnagar Police Station, Suryapet/ Nalgonda District and also heard learned Public Prosecutor representing the State, before ordering notice to respondent No.2 and perused the grounds in the quash petition and F.I.R. It is the further submission that even F.I.R. no way discloses any of the names of the petitioners/ accused. Once there is nothing, if at all the remedy is any apprehension to obtain anticipatory bail. Needless to say, if the police during the course of investigation got any material, they are entitled to show any other accused if at all involved disclosed from such investigation.

Having regard to the above, there is nothing to interdict the investigation from that leave about other remedy of anticipatory bail if any, but for, to observe while disposing of the Criminal Petition that if at all the petitioners are shown involved from the investigation and any necessity of their arrest, the police strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1.
