THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37694 of 2016 ORDER :

The petitioner's grievance in the writ petition is that the Municipal Corporation, is not taking action against the 5th respondent who was making illegal constructions on the premises bearing No.16-2-50, Plot No.125, Akberbagh, Malakpet, Hyderabad.

When the matter is taken up learned Standing counsel informed the Court that the 5th respondent instituted O.S.No.847 of 2016 on the file VI Junior Civil Judge, City Civil Court, Hyderabad and the Court below granted injunction in I.A.No.253 of 2016 on 05.04.2016 against the Municipal Corporation. Therefore, the Municipal Corporation cannot take any further action. 3.

Having regard to the said submission, the relief sought for by the petitioner can not be granted and if the petitioner is aggrieved by the institution of the civil litigation, and granting of injunction, he shall work out his remedies as available in law. 4.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
