HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 19626 of 2002 ORDER:
When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation and he challenging the orders dated 28.02.2002 passed by the 1st respondent-Labour Court in I.D.No.114 of 1999 wherein no relief was granted to him. The petitioner was challenging the orders of removal before the Labour Court. He has sought a direction in this writ petition to set aside the orders of removal and reinstate him into service. The relief sought by him at this point of time cannot be feasible as he has attained the age of superannuation.
However, this Court is of the considered view that the writ petition can be disposed of directing the 2nd respondent corporation to pay the service benefits of the petitioner for the service rendered by him prior to his removal from service, if not already paid, in accordance with the Regulations, within a period of four (4) weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
