HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2391 of 2010 ORDER:

This writ petition was filed for the following relief: "A Writ of Mandamus may be issued declaring the impugned action of respondents 1 and 2 in granting construction permission in favour of respondents 3 and 4 in the land of the petitioner situated in Sy.No.343 (old), Sy.No.344 (old) and Sy.No.345 (old) co-related to new Sy.No.205/D & E situated at Waddepally village, Hanumakonda Mandal, Warangal District, in spite of raising objection by the petitioner and without considering such objection, as illegal and arbitrary."

It is represented by the learned Standing Counsel for respondent No.1 that the construction of the building was complete and there is no interim order in the present writ petition.

Notice to respondents 3 and 4 was also not served and the writ petition was dismissed as against them. In the absence of respondents 3 and 4, the relief sought for in the writ petition cannot be granted. 4.

The Writ Petition is accordingly dismissed. However, it is open to the petitioner to challenge the permission already granted in favour of respondents 3 and 4 in an appropriate proceedings in accordance with law. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
