HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.27223 OF 2012 ORDER:
This writ petition is filed seeking a direction to the 2nd respondent i.e, A.P. Housing Board to consider the representation of the petitioner dated 25.07.2012 seeking to regularize 96 sq. yards stray piece of land belonging to the A.P. Housing Board situated beside Flat No.4, Block No.22, Vignanapuri colony, Vidyanagar, Hyderabad in terms of G.O.Ms.No.6 Housing (HB-II) Department dated 29.03.2011, issued by the Government of A.P, Housing (HB-II) Department. Heard Sri V. Ravi Kiran Rao, learned counsel for the petitioner, learned Government Pleader for the 1st respondent and the learned standing counsel for the respondents 2 and 3. When the writ petition came up for hearing on 10.09.2012, writ petition was admitted and notice was ordered on the respondents and the following interim direction was passed:
"There shall be a direction to the second respondent to consider the representation submitted by the petitioner on 25.07.2012 seeking allotment of stray piece of land adjoining the Housing Board Block No. 22, Vignanapuri Colony, Vidyanagar, Hyderabad, in terms of G.O.Ms. No. 6, Housing (HB-II) Department, dated 29-032011, pending further orders. It is made clear that it is open to the second respondent to consider the petitioner's representation on its own merits, by examining whether G.O.Ms. No. 6, dated 29-03-011 applies to the case of the petitioner or not." Today, when the matter is taken up for hearing, the learned counsel for the petitioner represented that in spite of the interim order dated 10.9.2012, passed by this Court in W.P.M.P.No.34662 of 2012, the representation of the petitioner is not yet disposed of.
Having regard to the facts and circumstances of the case, I deem it appropriate to direct the 2nd respondent to consider the representation submitted by the petitioner on 25.07.2012 seeking allotment of the stray piece of land adjoining the Housing Board situated beside Flat No.4, Block No.22, Vignanapuri colony, Vidyanagar, Hyderabad, as expeditiously as possible preferably within a period of two months from the date of receipt of copy of this order and pass appropriate orders in accordance with law.
With the above direction, the writ petition is disposed of. No order as to costs.
Consequently, the Miscellaneous Petitions, if any pending shall stand closed.
