HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11097 of 2019 ORDER:
The grievance of the petitioners is that the Revenue Divisional Officer, Sangareddy District, is not disposing of the interlocutory application filed by them in the statutory appeal bearing No.ROR/6011/2018. The said appeal was filed under Section 5(5) of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. In the light of the order proposed to be passed by this Court, there is no necessity to put respondent Nos.5 and 6 on notice or afford them an opportunity of hearing at this stage. A hierarchy of statutory remedies is provided to the citizen under the the Telangana Rights in Land and Pattadar Pass Books Act, 1971, so that speedy justice is rendered in such cases where valuable property rights of the parties are involved. It is therefore not open to a statutory quasi-judicial authority to remain inactive upon the interlocutory application filed in a statutory appeal before it.
The Writ Petition is accordingly disposed of directing the Revenue Divisional Officer, Sangareddy District, to forthwith take up the interlocutory application filed in the petitioners' statutory appeal and pass appropriate orders thereon in accordance with the due procedure. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy
