HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioners claim that house plots were allotted to them in Sy.No.143 of Kothagudem town. Proceedings were issued to that effect in the year 2005 on collection of land value and stamp duty. Petitioners claim to have raised small houses and residing therein and paying property tax. Petitioners earlier filed W.P.No.69 of 2005 and withdrew the writ petition. Taking advantage of the Government Order in G.O.Ms.No.59, applications were made to regularize the unauthorized occupation.

In this writ petition, petitioners also placed reliance on Government Policy notified in G.O.Ms.No.171 Revenue (Assignment-I) Department, dated 19.07.2017 for Kothagudem town. Alleging inaction on the said regularization applications, this writ petition is filed.

Learned Government Pleader, on instructions, submits that in fact, assignment cannot be granted to land, claimed by petitioners, as the same is on Northern side of Railway Track in Sy.No.143 allotted to Notified Area Committee in the year 1980 and, therefore, question of assignment of individual house plots does not arise. Learned Government Pleader also submits that large number of applications are received praying for grant of such regularization and requests at least three months time to undertake the process.

Be that as it may, applications submitted by the petitioners are pending consideration. Therefore, without expressing any

opinion on merits, writ petition is disposed of directing the Tahsildar, Kothagudem (3rd respondent) to examine claim of petitioners and pass appropriate orders as warranted by law assigning due reasons in support of its decision within a period of three months from the date of receipt of copy of this order. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
