Heard Smt. M.Suguna, learned counsel for the petitioner. The relief sought for in this writ petition is to declare the action of respondents 1 and 2 in selecting the 3rd respondent for the post of Anganwadi Worker of Marripadu SC Colony, Marripadu Mandal, Nellore District as illegal and arbitrary.
The appointment of the 3rd respondent was made pursuant to an interview held on 01.12.2006. The petitioner claims that she is more meritorious than the 3rd respondent despite which the 3rd respondent was selected on 05.01.2007. This Court, in the exercise of its jurisdiction under Article 226 of the Constitution of India, would not undertake an evaluation of the comparative merits of the candidates who appeared for selection. Moreover no interim order was passed at the stage of admission and the 3rd respondent has been working in the said post for more than a decade. I see no reason, at this stage, to examine the validity of the appointment of the 3rd respondent doning the robes of an appellate authority.
The Writ Petition fails and is, accordingly, dismissed.
Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
