The revision came for admission and, after hearing both sides and from perusal, the Court felt it to dispose of at this stage itself instead of keeping the matter pending. A perusal of the impugned order of the learned Collector that was confirmed by the learned District Judge of the clandestine dealing is supported by cogent reasons with finding that no where requires interference, but so far as not entering in B-register, of broken rice and rice of respective quantities of 126.50 and 570 on ground balance, whereas there is nothing on the book balance. It is for that the learned Collector imposed penalty of 20% of the total value of the seized stock which is in fact in variance. The learned District Judge confirmed the same. Even the order of the District Collector shows it is only not entering in B-register and not even supported by any bills.

Having regard to the above, reducing 20% to 15% while sitting in revision there is nothing to interfere. With the modified order, the Criminal Revision Case is disposed of.

Miscellaneous applications, if any, pending shall stand disposed of.
