THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL APPEAL No.1812 OF 2007 JUDGMENT:

This Criminal Appeal, under Section 374(2) of the Code of Criminal Procedure, 1973, is directed against the judgment, dated 13.3.2006, in Sessions Case No.146 of 2005 on the file of the Assistant Sessions Judge, Vizianagaram whereunder and whereby, appellant herein/accused was found guilty of the offence punishable under Section 376(2)(F) of the Indian Penal Code, 1860 and accordingly, convicted and sentenced to undergo rigorous imprisonment for a period of ten years and to pay a fine of Rs.100/- and in default, to undergo simple imprisonment for a period of one month.

2. When the matter is taken up for hearing, learned Public Prosecutor informed this Court that the appellant has already served the entire sentence imposed by the trial Court and hence, nothing survives for adjudication in this appeal.

3. Recording the said submission, this Criminal Appeal is disposed of confirming the conviction and sentence imposed against the appellant in the judgment, dated 13.3.2006, in Sessions Case No.146 of 2005 on the file of the Assistant Sessions Judge, Vizianagaram.

4. Miscellaneous petitions pending, if any, in this Criminal Appeal shall stand closed.
