HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3422 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioner/accused seeking to quash the proceedings against him in Crime No. 203/2018 of Miyapur Police Station registered for the offences under Sections 420 & 506 of IPC. A plain reading of the allegations in the complaint would show that there is a prima facie accusation for the offences under Sections 420 & 506 IPC. As per the submission of the learned Additional Public Prosecutor, the investigation is under way and so far three witnesses are examined. In that view of the matter, it is not a fit case at this stage to quash the proceedings. Hence, investigation has to be continued. However, in view of the fact that the crime is registered for the offences under Sections 420 & 506 IPC, the Investigating Officer shall strictly follow the procedure contemplated under Section 41-A Cr.

P.C during the course of investigation. The petitioner/accused shall cooperate with the investigating agency for smooth completion of investigation. Accordingly, the Criminal Petition is disposed of.
