O R D E R

This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.2 in FIR No.1953 of 2025 of Cyber Crime Police Station, Hyderabad District, registered for the offences punishable under Sections 66-C and 66-D of the IT Act and Sections 111(2)(b), 318(4), 319(2), 336(3), 338, 340(2) of the BNS.

The case of the prosecution is that, on 28.10.2025, the de-facto complainant lodged a report before the police stating that the de-facto complainant, who is the retired Central Govt. Employee, deposited the amount believing that it is a genuine investment platform and he deposited total amount of Rs.54,80,000/- and when he opted for withdrawal of the amount to the customer services of Market Axess have asked to pay the tax amount of Rs.25,20,000/- on the profit of Rs.83,94,920/- and the defacto complainant has paid the amount than the customer services demanded money one after another, then he suspected it is a fraud. Hence, the complainant requested to take necessary action. Basing on the same, the police registered a case for the above said offences. 3.

Heard Sri D. Bhaskar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and there are

- 3 - no specific allegations against the petitioner herein and accused No.1 was already released on bail and the petitioner is in jail since 17.02.2026 and the entire investigation is already completed and further custodial interrogation of the petitioner is not required. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner herein are serious in nature. It was further submitted that the petitioner facilitated the commission of a large-scale financial fraud, thereby, cheated the victim with a huge financial fraud, which requires further investigation. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is accused No.2 and he is in jail since 17.02.2026. As seen from the

- 4 - remand case diary, the prosecution witnesses, LWs 1 to 11 have already been examined. Further, accused No.1, who is the prime accused is already granted bail. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned IX Additional Chief Judicial Magistrate, at Nampally, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose

- 5 - of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
