THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.9240 OF 2018 ORDER:

Heard learned counsel for the petitioners and the learned Government Pleaders for Irrigation and Revenue. Despite service of notice, none appeared for respondent Nos.6 and 7. The petitioners herein claim to be the residents of Postal Colony, Peruru Village, Amalapuram Mandal. The alleged inaction on the part of the respondents in not removing the illegal encroachments made on left bank of Kummari Kalava main drain from 9.700 K.M. to 8.700 K.M., Peruru/Edarapalli Village, Amalapuram Mandal, East Godavari District is under challenge in the writ petition.

It is brought to the notice of this Court that the Deputy Executive Engineer vide letter dated 15.11.2017 made a request to the Revenue Divisional Officer, Amalapuram to take appropriate action in the matter. It is also brought to the notice of this Court that the petitioners herein submitted a representation to the District Collector, East Godavari District on 19.06.2017 for redressal of their grievance. It is also submitted that copies of the said representation were submitted to various authorities but no action is taken so far.

Having heard the learned counsel for the petitioners and the learned Government Pleaders for the respondents, this Court deems it appropriate to dispose of the writ petition with a direction to the respondent-authorities to verify the representation dated 19.06.2017 said to have been submitted by the petitioners herein and take appropriate action in accordance with law and also

keeping in view the letter of the Deputy Executive Engineer, Amalapuram addressed to the Revenue Divisional Officer on 15.11.2018, within a period of six weeks, from the date of receipt of a copy of this order.

The Writ Petition is disposed of, accordingly. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
