O R D E R

The case of the petitioner, as per the averments made in the affidavit filed in support of the writ petition, is that he was initially working as night watchman (Full Time Contingent Worker) with effect from 01.01.2005 in RFWC Banigandlapadu and later posted to Primary Health Centre, Maturupeta with effect from 01.01.2012 on a consolidated pay of Rs.625/- per month (class IV) on contract basis in the existing vacancy. By proceedings of the 2nd respondent - District Medical and Health Officer, Khamma in Rc.No.E6/1028/2013 dated 12.04.2013, his engagement was ratified and the 3rd respondent - Medical Officer, PHC, Maturupeta was directed to regulate the pay of the individual as per G.O.Ms.No.238 Fin., dated 23.09.2005 and G.O.Ms.No.171 Fin., dated 13.05.2010, as admissible from time to time.

Subsequently, by proceedings of the 3rd respondent in Rc.No.A1/FTCW/2013 dated 10.06.2013, the pay of the petitioner, as full time contingent worker of PHC, was fixed at Rs.6,700/- with effect from 01.01.2012 with usual allowances in the revised pay scales 2010 in the time scale of pay of Rs.6700-20110. Now the grievance of the petitioner is that in spite of fixation of his pay as full time contingent worker, 3rd respondent issued letter in Rc.No.G1/021/2016 dated 19.08.2016 for payment of his salary and issued demand draft for Rs.20,000/-. For payment of salaries, petitioner made representation to the 3rd respondent and he in turn by proceedings dated 26.09.2017 forwarded to the 2nd respondent. Aggrieved by the inaction of respondents in considering his representation for payment of salaries, present writ petition is filed.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Medical and Health.

Having regard to the above averments made in the writ affidavit and the submissions of the learned counsel, without expressing any opinion on merits, the writ petition is disposed of directing the 2nd respondent to consider the representation of the petitioner forwarded by the 3rd respondent through letter dated 26.09.2017 and take appropriate action in accordance with law for payment of entire salaries due to the petitioner.
