HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11127 of 2019 ORDER:

The grievance of the petitioner, an ex-serviceman aged 82 years, is that his application for issuance of a No-Objection certificate in terms of G.O.Ms.No.307, Revenue (Assignments-I) Department, dated 06.6.2013, is not being acted upon, despite the fact that the same was received by the office of the District Collector, Wanaparthy District, in March 2019 itself. The case of the petitioner is that he was allotted a piece of land by virtue of being an ex-serviceman and in terms of the Government policy, he would be at liberty to sell the same after expiry of the prescribed ban period of ten years. He submitted representation dated 15.3.

2019, a copy of which was received by the office of the District Collector, Wanaparthy District, wherein he cited the reasons for selling the allotted land and sought issuance of a No-Objection certificate under G.O.Ms.No.307 dated 06.6.2017. Be it noted that the policy of the Government in this regard is spelt out in G.O.Ms.No.307 dated 06.6.2017. Having received the petitioner's representation, it is not open to the District Collector, Wanaparthy District, to remain somnolent.

The Writ Petition is accordingly disposed of directing the District Collector, Wanaparthy District, to take appropriate action upon the petitioner's representation dated 15.3.2019, keeping in mind the Government's policy as spelt out in G.O.Ms.No.307 dated
