ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.4 to 6 in Crime No.20 of 2026 before the Ibrahimpatnam Police Station, Jagtial District, registered for the offence

punishable under Sections 103(1), 126(2), 238 read with 3(5) of BNS.

The brief facts of the case are that on 21.02.2026, upon receiving information, the complainant found one Limbadri lying dead with head injuries in an agricultural field at Erdandi village. It is alleged that the deceased had prior disputes with his wife and family members, and on the previous night, a quarrel took place between them.

Subsequently, unknown persons are alleged to have murdered the deceased with a hard object. During investigation, the present petitioners (Accused Nos.4 to 6) were arrayed as accused and were taken into custody.

Heard Sri P. Raju, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachander Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated only on suspicion and alleged confessional statements, which are inadmissible in law. He further submitted that there is no

prima facie material against them and no proper evidence connecting them with the offence and that the mandatory procedure of informing grounds of arrest was not followed, rendering the arrest illegal. He further contended that investigation is already completed, the petitioners are students with no criminal antecedents, and their continued detention would adversely affect their future. Therefore, he prayed the Court to grant bail to the petitioners by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the petition contending that the offence alleged is a grave one involving murder, and the petitioners were arrayed as accused during the course of investigation. He further submitted that there are allegations against the petitioners in connection with the offence and the matter is serious in nature. Therefore, considering the gravity of the offence and the stage of the case, the petitioners are not entitled for the bail.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since

23.02.2026. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 12 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the JMFC Metpally, Jagitial District.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
