THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.11077 of 2019 ORDER:

The prayer of the petitioners in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore, prayed that this Hon'ble Court may be pleased to issue any appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the Respondent No.2 in considering the petitioners' application dated 16-01-2019 for grant of Occupancy Rights in respect of the land in Sy.No.286 to an extent of Ac. 11-22 gts; Sy.No.287 to an extent of Ac.6-00 gts and Sy.No.288 to an extent of Ac.2-00 gts., total admeasuring Ac.19-22 gts., situated at Kongara Khurd "A" Village, Maheshwaram Mandal, Ranga Reddy District, as being illegal, arbitrary and unconstitutional and consequently direct the respondent No.

2 to forthwith conduct enquiry in respect of the Petitioners' application dated 16-01-2019 for grant of ORC in respect of the land in Sy.No.286 to an extent of Ac.11-22 gts; Sy.No.287 to an extent of Ac.6-00 gts and Sy.No.288 to an extent of Ac.2-00 gts., total admeasuring Ac.19-22 gts., and pass any order or other orders as this Hon'ble Court deems fit and proper in the circumstances of the case.'

Perusal of the record reflects that the office of the Revenue Divisional Officer, Kandukur Division, received the application of the petitioners submitted on 16.01.2019 on the very same day. The complaint of the petitioners is that no action has been taken thereon. It is not open to a statutory authority to remain somnolent when an application has been submitted in the prescribed format. The writ petition is accordingly disposed of directing the Revenue Divisional Officer, Kandukur Division, to take appropriate action upon the petitioners' application dated 16.01.2019 in accordance with law

expeditiously and in any event, not later than three months from the date of receipt of a copy of this order, be it from whatever source.
