HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 22190 of 2002 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioners were challenging the orders dated 07.02.2002 passed by the 2nd respondent-Labour Court in I.D.No.40 of 2001 wherein no relief was granted to them. The 1st petitioner was challenging the orders of removal before the Labour Court and during pendency of the I.D., the 1st petitioner expired and petitioners 2 to 4 were brought on record. The petitioners sought a direction in this writ petition to set aside the orders of removal and reinstate the 1st petitioner into service with consequential benefits.

The learned counsel further submits that as the 1st petitioner has expired, appropriate orders be passed directing the respondent corporation to pay the service benefits of the deceased 1st petitioner for the service rendered by him prior to his removal from service to his legal representatives i.e., petitioners 2 to 4. Having considered the submission of the learned counsel for the petitioner, this Court is of the view that the writ petition can be disposed of directing the 1st respondent corporation to pay the service benefits of the deceased 1st petitioner for the service rendered by him prior to his removal from service to his legal representatives i.e.

Regulations, within a period of four (4) weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 14th December, 2018 cbs
