THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8345 of 2015 ORDER:
This Criminal Petition is filed by the petitioner-Accused No.2 under Section 438 Cr.P.C. seeking to grant anticipatory bail to her in FIR No.83 of 2014 on the file of the Porumamilla Police Station, Porumamilla, Y.S.R. District, registered for the offence punishable under Sections 419, 420, 468 & 471 r/w 34 and 120-B IPC. Heard and perused the material available on record. The case of the prosecution is that the father of the de facto complainant worked in military and retired and made an application for assignment of land. He was assigned land in an extent of Ac.5.01 cents in Sy.No.1281/3 of Rangasamudram village, Porumamilla Mandal, YSR District and later he died leaving behind his wife and the de facto complainant as legal heirs. Thereafter, the de facto complainant came to know that the land owned by his father was sold by one unknown woman by posing herself as mother of the de facto complainant and by forging the signature of his mother. The de facto complainant had also shown his mother as L.W.2.
It is the case of the petitioner that she is the mother of the de facto complainant. The learned Public Prosecutor disputed the same. Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
