HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3503 OF 2018 ORDER:

This petition is filed under Section 482 Cr.P.C. by the petitioners/A.5, A.6, A.7, A.9, A.12, A.13 and A.16 seeking to grant anticipatory bail in C.C.No.4 of 2016 on the file of Metropolitan Sessions Judge-cum-Special Court under A.P.Protection of Depositors of Financial Establishment Act,1999 of Gajuwaka Police Station, Visakhapatnam City wherein cognizance was taken for the offences under Sections 4, 5 & 6 read with 2 (c) of the Prize Chit and Money circulation Schemes (Banning) Act, 1978 and Section 5 read with 3 of A.P.Protection of Depositors of Financial Establishment Act, 1999. Heard the learned counsel for the petitioners and learned Additional Public Prosecutor.

The submission of learned counsel for the petitioners is that in Writ Petition No.9672 of 2014, in respect of the petitioners therein and employees of N.Mart Retail (Division of New Look Retails Private Limited), an order was passed by this Court on 3-4-2014 staying their arrest and same was extended from time to time and the same is in force.

His further submission is that in spite of the same, the trial court, while taking cognizance of the Charge Sheet, ordered N.W.B. against A.5 to A.7, A.9, A.12 to A.17. He therefore, prays that either the anticipatory bail may be granted to them or the N.B.W. issued against them may be ordered to be recalled.

Learned Additional Public Prosecutor left the matter to the discretion of the Court.

Heard.

In the circumstances of the case, petitioners/A.5, A.6, A.7, A.9, A.12, A.13 and A.16 are directed to appear before the trial court on or before 10th May, 2018 and move application for recalling of N.B.Ws. issued against them, in which case, the trial court shall recall N.B.Ws. on suitable terms. The petitioners are directed to co-operate with the trial court for smooth completion of trial. This Criminal Petition is disposed of accordingly. As a sequel, miscellaneous applications pending if any, shall stand closed.
