The present petition is filed under Section 482 Cr.P.C. seeking modification of the order dated 30.03.2015 passed in Crl.M.P.No.843 of 2015 in HQPOR No.21 of 15-Cus-Pre Passed by the Special Judge for Economic Offences-VIII Additional Metropolitan Sessions Judge, Hyderabad, wherein the learned judge while releasing the petitioner on bail imposed a condition that the petitioner should execute a personal bond for Rs.1,00,000/- with two sureties for a like sum each shall deposit the passport and attend before the Superintendent of Customs(Prev.), Hyderabad Commissionarate, Hyderabad on 1st of every month.

Learned counsel for the petitioner submits that even though the impugned order came to be passed on 30.03.2015, till date the petitioner could not avail the same as he is unable to furnish two sureties for Rs.1,00,000/- each. Learned counsel submits that the petitioner is a resident of Tamilnadu and as the amount imposed is on higher side seeks reduction of the same. On the other hand, learned Public Prosecutor opposed the same. As seen from the record, the petitioner was arrested on 02.03.2015 for the offences punishable under Sections 132 and 135 of the Customs Act and he was granted bail on 30.03.2015. Though the order came to be passed 20 days ago, till date he could not secure the sureties.

Having regard to the facts and circumstances of the case, the criminal petition is disposed of by modifying the condition imposed in the impugned order by directing the petitioner to execute a bond for Rs.50,000/- with two sureties for a like sum each instead of Rs.1,00,000/- with two sureties for a like sum each, to the satisfaction of the said Court. The other conditions imposed in the order dated 30.03.2015 shall remain unaltered. _________________________________ JUSTICE C. PRAVEEN KUMAR 21.04.
