THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD CONTEMPT CASE (TR) NOs.490 AND 492 OF 2017 C O M M O N O R D E R (Per Hon'ble Sri Justice Sanjay Kumar) C.C.(TR) Nos.490 and 492 of 2017 stood transferred to the file of this Court upon abolition of the Administrative Tribunal in the State of Telangana. These contempt cases were instituted alleging willful disobedience to the orders dated 19.04.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad (hereinafter, 'the Tribunal'), in O.A.Nos.3551 and 3538 of 2014 respectively. As per the said order, the State Level Police Recruitment Board was required to recast the selection list relating to special category posts by first accommodating the applicants in the O.As. under special categories in the posts of Stipendiary Cadet Trainee Sub-Inspector of Police as per merit and thereafter take measures in relation to the unofficial respondents in O.A.Nos.8346 of and batch.

In purported implementation of this order, the Telangana State Level Police Recruitment Board, Hyderabad, issued proceedings in two separate Memoranda dated 22.11.2017 informing the petitioners in these contempt cases that they did not come within the zone of consideration and could not be selected. Sri R.V.Mallikarjuna Rao, learned counsel for the petitioners in the two contempt cases, advanced arguments at length as to how the aforestated proceedings do not constitute proper compliance with the directions of the Tribunal.

We are however of the opinion that the merits of the purported compliance cannot be reviewed in contempt jurisdiction. If the petitioners have any grievance with the Memoranda dated 22.11.2017, they necessarily have to challenge the same by way of separate proceedings.

The contempt cases are accordingly closed leaving it open to the petitioners in these two contempt cases to seek redressal of their grievances, if any, with regard to the Memoranda dated 22.11.2017 by way of independent proceedings in accordance with law. _______________ SANJAY KUMAR, J __________________ T.AMARNATH GOUD, J 11th JULY, 2018 Svv
