THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1334 OF 2015 ORDER:
The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 18.06.2015 passed in Crl.M.P.No.1176 of 2015 in C.C.No.159 of 2015 on the file of the XV Additional Chief Metropolitan Magistrate-cum-Special Court for Trial Video Piracy Cases, Hyderabad, whereby the Court below dismissed the petition filed by the petitioner for return of the passport, for the reason that the matter is pending for examination of the accused.
Heard and perused the material available on record. The learned counsel for the petitioner submits that he intends to go to a foreign country in search of job and as such, he prays this Court for issuance of passport.
Considering the facts and circumstances of the case and also the petitioner being the breadwinner of the family, he cannot be curtailed to go abroad for his job because of the pendency of the case. Hence, the trial Court is directed to return the passport on execution of personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) and also on deposit of cash of Rs.1,00,000/- (Rupees one lakh only). Further, the petitioner is directed to appear before the Court concerned as and when insisted by the Court for the purpose of completion of the trial.
With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
