HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.17203 OF 2009 ORDER:

The proceedings, under challenge in this Writ Petition, is dated 24.03.2005 whereby the petitioners were called upon to show cause why the patta granted to them should not be cancelled for their having violated the patta rules. Aggrieved by the show cause notice issued to them, the petitioners have invoked the jurisdiction of this Court. In proceedings under Article 226 of the Constitution of India, this Court would not, ordinarily, interfere with a mere show cause notice as the petitioners can as well file their reply thereto urging all the contentions raised by them in this Writ Petition. I consider it appropriate, therefore, to dispose of the Writ Petition permitting the petitioner to file their reply to the show cause notice, raising all such contentions as are available to them in law, within three weeks from today.

In case the petitioners file their reply to the show cause notice within the aforesaid period of three weeks, the respondents shall consider the same and pass a reasoned order in accordance with law before they take any further action regarding cancellation of the patta. It is made clear that, in case the petitioners fail to submit their reply to the show cause notice within the aforesaid period of three weeks, it would then open to the respondents to proceed to cancel the subject patta in accordance with law. The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.
