HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6691 of 2017 ORDER:

Heard learned counsel for the petitioner/accused in crime No.209 of 2017 of Marredpally Police Station, Hyderabad, registered for the offence punishable under Section 3(1)(r) of SC & ST (POA) Act and learned Public Prosecutor representing the State and also the learned counsel for the 2nd respondent and perused the FIR and the grounds urged in the quash petition and the other material on record.

A perusal of the very report no way attracts Section 3(1)(r) & (s) of SC & ST (POA) amended Act and this Court on 04.08.2017 granted stay of arrest for six (06) weeks therefrom. There is nothing to show from the 2nd respondent-defacto complainant by filing any counter. What learned Public Prosecutor says is in the statement of victim though she did not disclose many details as to there is any public view, mentioned about the alleged incident happened in Court hall and the Court bench typist also there very near to her among others to see or view the occurrence and it requires investigation including of the Court staff if at all. Having regard to the above, the Criminal Petition is disposed of by making absolute the interim order of stay of arrest pending investigation. All available defence of the accused is left open.
