HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 4440 of 2015 Order:

This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the orders, dated 24.03.2015, passed in Crl.M.P. No. 626 of 2015 in CC No.59 of 2014 by the XIV Metropolitan Magistrate, Cyberabad, at L.B. Nagar. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the State. Having perused the order of the learned Magistrate, whereunder the petitioner/accused was directed to deposit his passport in the Court to secure his presence for the purpose of trial, I do not see any irregularity or illegality in the order passed by the learned Magistrate to interfere with the same. The Criminal Petition is devoid of merit and the same is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed. However, it is made clear that as and when the petitioner feels necessity of the original passport, he can make an application before the learned Magistrate for return of his passport and, on such application being made the learned Magistrate shall consider and dispose of the same in accordance with law.
