HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45247 of 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking to declare the action of the 2nd respondent in proceeding to mutate the land in survey No.790/11/U admeasuring Ac.0.15 guntas and land in survey No.790/11/R/A/AA admeasuring Ac.0-10 guntas situated at Kondraganibodu Thanda H/o.Kadthal Village and Mandal of Ranga Reddy District, in the name of respondents 5 and 6 without considering the objections of the petitioners, as illegal and arbitrary.
Heard the learned counsel for the petitioners and the learned AGP for Revenue for respondents 1 and 2. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondents 3 to 6 on notice since this Court is not venturing to adjudicate the case on merits. The main grievance of the petitioners in this writ petition is that though they submitted objections for the proposed mutation of lands in the name of respondents 5 and 6, without considering the same the 2nd respondent is proposing to mutate the lands in their names.
Learned AGP would submit that a suitable direction may be given to the 2nd respondent to consider the objections raised by the petitioners before mutating the names of respondents 5 and 6 in the revenue records.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-The Mandal Revenue Officer to consider the objections submitted by the petitioner while mutating the names of respondents 5 and 6 in revenue records in respect of land in survey No.790/11/U admeasuring Ac.0.15 guntas and land in survey No.790/11/R/A/AA admeasuring Ac.0-10 guntas situated at Kondraganibodu Thanda H/o.Kadthal Village and Mandal of Ranga Reddy District, in accordance with law. If no objections are submitted by the petitioners till date, they shall submit the same within a period of one week from today.
Miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
