This Second Appeal is filed against the judgment and decree dated 02.03.2001 passed in A.S.No.40 of 1997 on the file of the Court of the II Additional Chief Judge, City Civil Court, Hyderabad.

The appellant failed to pursue the matter. In spite of multiple adjournments for hearing the appeal, there was no inclination from the counsel for appellant to proceed with the arguments. Though the matter is listed on under the caption "for dismissal", no representation from appellant's side. Hence, the Second Appeal is dismissed for non-prosecution. 3.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
