09.04.2025 JSR,J I.A.No.1 of 2025 This application is filed invoking the provisions of Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') seeking relaxation of the conditions imposed against the petitioner-accused No.1.

Mr.Kadire Ajith Reddy, learned counsel for the petitioner submitted that the petitioner has been complying the conditions which are imposed by this Court vide order dated 03.05.2024 while granting the bail in his favour. It is further submitted that petitioner is appearing on each and every adjournment in S.C.No.154 of 2024 before the IV Additional Metropolitan Magistrate, Hyderabad and also appearing before the S.H.O on every Monday, pursuant to the order dated 03.05.2024. Learned counsel further submitted that accused No.2 was also arrested and he was enlarged on bail and the Investigating Officers filed charge sheet against accused No.2. He further submits before the S.H.O., that the presence of the petitioner is not required. He also submits that S.C.No.154 of 2024 is coming for framing of the charges only. Unless the said condition is relaxed, the petitioner will be put to irreparable loss and hardship.

Mr.Syed Yasar Mamoon, learned Addl. Public Prosecutor has not disputed the same.

OFFI CE NOTE by the learned counsel for the petitioner and after perusing the record, it reveals that since 03.05.2024 the petitioner is appearing before the S.H.O on every Monday and also appearing before the learned IV Metropolitan Sessions Judge at Hyderabad in S.C.No.154 of 2024 for each and every adjournment.

Taking into consideration the facts and circumstances of the case this Court deems it appropriate to relax the condition No. (V) in order dated 03.05.2024 in Criminal Petition No.4716 of 2024. However, the other conditions imposed by this Court will continue.

Accordingly, this application is ordered.
