THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.7861 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit the petitioner herein pray that this Hon'ble court may be pleased to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents herein in trying to lay road in vacant land of the petitioner in Door No.27-1148, Ward No.22 having Municipal Assessment Nos.19326 and 19326-A situated at Karalmarx Road (Eluru Road), Vijayawada, Krishna District without acquiring the same and without paying any compensation to the petitioner as illegal, arbitrary, null and void and for a consequential direction to the respondents to drop all further proceedings relating to laying of road in the lands of the petitioner and to pass such other order and further orders."
Learned Assistant Government Pleader placed before this Court a copy of the written instructions dated 09.03.2016 furnished by the Executive Engineer, R&B Division, Government of Andhra Pradesh, Vijayawada, wherein the Executive Engineer stated that there was no proposal to lay any road in the petitioner's land. He further stated that there were no proposals to widen the existing R&B road and therefore, the question of acquiring the land of the petitioner did not arise.
In the light of the afore-stated written instructions, Sri M.V. Suresh, learned counsel for the petitioner, has no objection to the closure of the case recording the stand of the respondent authorities. The writ petition is accordingly closed.
