ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 and 2 in Crime No.248 of 2026 of Jeedimetla Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 108 r/w 3(5) of the BNS.

The case of the prosecution is that, on 17.03.2026, the de-facto complainant lodged a report before the police stating that on 12.03.2026, Erra Pavan, who was residing in a rented house at Chintal Srinivas Nagar, ingested poison. His friends discovered his condition two hours later and immediately transported him to Pranadhara Hospital in Chintal. Upon inquiry, Mr. Pawan disclosed that A.1 had arranged a loan of Rs.10,00,000/- with exorbitant interest terms, demanding monthly payments of Rs.1,50,000/-. Despite making payments for three years, the principal amount remained unchanged. He further stated that he was subjected to severe harassment when unable to meet the demands. In addition, the accused persons also harassed him for money. Unable to endure the continued pressure and harassment, the deceased consumed poison, Despite medical intervention, he succumbed to the effects and passed away at Pranadhara Hospital. Hence, he requested for necessary action. Basing on the said complainant, the police registered a case for the above said offences. 3.

Learned counsel for the petitioners submitted that the averments in the report does not constitute the offence under Section 108 of the BNS and merely asking for repayment of money does not amounts to commit suicide and the petitioners are innocent of the said allegations and even according to the de-facto complainant, there are persons harassed the deceased for repayment of the amount, which itself shows that there is no specific allegation against the petitioners herein and they are ready to cooperate with the investigating authority. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioners stating that the allegations against the petitioners are serious in nature and the names of the petitioners herein are mentioned in the report by the de-facto complainant showing that the petitioners herein harassed the deceased, as such, he committed suicide. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it is evident that the petitioners herein are accused Nos.1 and 2 and the allegations against them are that they gave loan of Rs.10,00,000/- and also Rs.30,000/- to the deceased and asking for the repayment of the same, except this allegation, there is no such allegation to show that the petitioners herein abetted the deceased with a mens rea to commit suicide. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Jeedimetla Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
