HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.3 and 4 of 2019 In/and CRIMINAL PETITION No. 3620 of 2018 ORDER:

The petitioner, who is the sole accused in C.C.No.417 of 2016 on the file of the XII Addl. Chief Metropolitan Magistrate, Nampally, Hyderabad, filed this Criminal Petition under Section Cr.P.C.

to quash the proceedings in the above C.C. A charge sheet came to be filed against the petitioner for the offences punishable under Sections 447, 427, 420, 468, 471, 384 and 506 r/w 34 IPC.

2. The complainant Hari Kishan Agarwal, represented by his son and GPA Holder namely Atul Kumar Agarwal, who is the practicing Advocate of this High Court is personally present before this Court. For the purpose of identification, the parties have furnished copy of Aadhar Cards and photographs, which have been duly identified by their respective counsel. Copy of GPA executed by the complainant-Hari Kishan Agarwal is also filed. I.A.Nos.3 and 4 of 2019 are filed to record the compromise and to compound the offences. Along with the petitions, a joint compromise memo came to be filed, which is supported by the affidavit of the complainant. The affidavit and the joint

compromise memo have been duly signed by the respective parties and their signatures are also duly identified by their respective counsel.

According to the joint compromise memo, the petitioner herein has been arrayed as sole accused in C.C.No.417 of 2016 on the file of the XII Addl. Chief Metropolitan Magistrate, Nampally, Hyderabad. During the pendency of the said C.C., both parties have amicably settled their disputes out of the Court Hence, 2nd respondent has no objection to quash the proceedings against the petitioner.

4. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.3 and 4 of 2019 are ordered.

5. Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in C.C.No.417 of 2016 on the file of the XII Addl. Chief Metropolitan Magistrate, Nampally, Hyderabad, against the present petitioner-accused are hereby quashed.
