THE HON'BLE SRI JUSTICE S. RAVI KUMAR C.M.A.No.738 of 2010 JUDGMENT:

When the matter was called on 20.07.2016, at request, the matter was directed to be posted to today. Today, though the matter is being listed under the caption "Specially Identified Cases", neither the advocate for appellants appeared nor any representation is made on his behalf.

2. As per the office endorsement, the appeal was admitted on 08.09.2010 and notice to respondents was ordered on 21.09.2010 and again on 05.10.2010, the matter was adjourned to be listed after service of notice on respondents. It appears that notice against 1st and 2nd respondents is served, whereas notice sent to 3rd respondent is not yet returned and proof of service is not filed.

3. Therefore, the Civil Miscellaneous Appeal is dismissed for nonprosecution. Miscellaneous petitions, if any, pending in this appeal shall stand dismissed.
