HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11217 of 2019 ORDER:
The grievance of the petitioner is that the District Collector, Medak District, is not disposing of his Revision Petition filed on 18.5.2018 under Section 9 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971.
However, perusal of the record reflects that the Revision was in the form of a letter addressed to the District Collector, Medak District. In this regard, reference may be made to Rule 23 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989, which provides that a Revision under Section 9 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, should be made in writing and set forth concisely the grounds thereof. The revision petitioner is also required to pay a court-fee stamp of Rs.5/-. In that view of the matter, it is clear that the petitioner's so-called Revision is not in accordance with the prescribed procedure. Having failed to abide by the prescribed procedure, it is not open to the petitioner to complain of inaction on the part of the District Collector, Medak District, upon his defective Revision Petition.
The Writ Petition is therefore dismissed on this short ground. This order shall however not preclude the petitioner from filing a proper Revision in accordance with the due procedure. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
