HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION Nos.2508 AND 2510 OF 2017 COMMON ORDER:

The petitioners in the former petition are arraigned as accused Nos.1 and 2 in Calendar Case No.983 of 2011 on the file of XVI Metropolitan Magistrate, Cyberabad at Kukatpally, while the petitioner in latter petition is arraigned as accused No.3. Their request under Section 482 of the Code of Criminal Procedure, 1973 (for short 'the Code') is to recall warrant issued by the learned Magistrate on 03.03.2016.

2. Sri M.K. Raj Kumar, learned counsel for the petitioners would submit that the petitioners were earlier regularly attending the Court, but, somehow, on the date when non-bailable warrants were issued, they were not present and, therefore, requests to recall nonbailable warrants issued against the petitioners.

3. Of course, no further details are forthcoming. Be that as it may, keeping in view, that the Calendar Case relates to the year 2011 and not yet disposed of, and without attributing anything to either party, while rejecting the request of the petitioners to recall nonbailable warrants, they are given liberty to move applications under Section 70 (2) of the Code, in which case, the learned XVI

ASN,J Crl.P. Nos.2508 & 2510 of 2017 Metropolitan Magistrate, Cyberabad at Kukatpally, would dispose of the petitions on the same day in accordance with law. Accordingly, both the Criminal Petitions are dismissed at the admission stage itself. As a sequel thereto, miscellaneous petitions, if any, pending in the petitions, stand closed.
