BHATT WRIT APPEAL No. 1048 OF 2013 AND W.A.M.P.No.1545 of 2015 JUDGMENT: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the parties state that the appellants and respondent Nos.3 to 9 have settled their dispute amicably and they have placed memorandum of compromise filed under Order XXIII Rule 3 of the Code of Civil Procedure in W.A.M.P.No.1545 of 2015 before us, duly signed by them and the parties.

Memorandum of compromise is taken on record and marked as 'X' for identification. Statements made by parties in the memorandum of compromise and undertakings, if any, given by them are accepted. All appellants and respondent Nos.3 to 9 are present in the Court. Learned counsel appearing for them, who are also advocates on record, identified them and attested their signatures on the memorandum of compromise. Out of six appellants, we are informed, appellant No.3 understands English. Insofar as other appellants are concerned, we asked them whether they have understood the contents of memorandum of compromise and they said yes. They also stated that their Advocate has explained them and translated the contents of memorandum of compromise. Similarly, respondent Nos.3 to 9 also stated that their Advocate has explained and translated the contents of the memorandum of compromise and they have understood the same. Both the parties,

thus, state that they have signed the memorandum of compromise after understanding the contents thereof.

Learned counsel for the parties have therefore prayed for disposing of this appeal in terms of the memorandum of compromise. Appeal and W.A.M.P.No.1545 of 2015 are accordingly disposed of in terms of the memorandum of compromise.

Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
