THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12482 of 2016 ORDER:

Heard Sri S. Srinivasa Choudhary, learned counsel for the petitioner, and Sri Pasham Krishna Reddy, learned Standing Counsel for the Greater Hyderabad Municipal Corporation. The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may pleased to issue any appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.3 in proposing to lay the road in petitioner's patta land bearing of H.No.18-2-66 (Part of Sy.No.203) situated at Jangammet, Falaknuma, Hyderabad in pursuance of the notice dated 21-3-2016 and 30-3-2016, without following due process of law is illegal, arbitrary, unconstitutional and violative of principles of natural justice." The impugned notices dated 21.03.

2016 and 30.03.2016 demonstrate that the municipal authorities merely asked for the petitioner's ownership documents. Once the petitioner produces the same and if it is found that the land over which the municipal authorities proposed to lay a road is owned by the petitioner, the municipal authorities shall follow the due procedure laid down by law. Making this position clear, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
