HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.10439 of 2002 ORDER:

This Writ Petition is filed by the Senior Citizen for payment of gratuity as ordered by the authority in P.G.No.9/98, dated 31.03.2000, under Section 8 of the Payment of Gratuity Act, 1972 (for short, the Act) from 31.03.2000 till the amount is paid to the petitioner.

The 2nd respondent is employer of the petitioner. In spite of the order being passed by the competent authority under the Act, the 2nd respondent has not complied with the orders passed by the authority. In those circumstances, the present writ petition is filed.

This Court, vide order, dated 12.09.2002 was pleased to grant interim direction as prayed for. The interim direction prayed for is as follows:

"It is further prayed that this Hon'ble Court may be pleased to direct the 1st respondent herein, to recover the ordered Gratuity amount of Rs.29,852.00 in P.G.No.9/98, Dt.31.03.2000 under Section 8 of the payment of Gratuity Act, 1972 from 31.03.2000 to till the date of realization, within stipulated time, pending disposal of this petition and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." 4.

In view of interim orders passed by this Court, no further orders are necessary in this case. Respondent No.1 shall ensure that the gratuity amount is paid to the petitioner by the 2nd respondent, within a period of two (2) months from the date of receipt of a copy of this order, if not already paid.

With the above observation, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________________ ABHINAND KUMAR SHAVILI, J JULY 25, 2018 YVL
