THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.11142 OF 2010 ORDER:

This is an application of 2010 impugning the cognizance order of the learned Judicial Magistrate of First Class, Nandyal of C.C.No.176 of 2008.

Earlier proof of return filed of incomplete address and ordered notice afresh and on 10.08.2017, when the matter came for hearing, apart from notice ordered on 25.02.2016 and the police report shows there is no such person to be knowing, to take fresh notice and on 31.08.2017, directed to file proof of service and submit arguments else to dismiss. Even today, there is no representation.

Having regard to the above, this criminal petition is dismissed for non-diligence, however, without prejudice to raise all defenses available before the trial court to proceed with.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
