THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.42035 of 2015 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent No.2 in refusing to issue dispatch permits for transportation of mineral stone and metal in over an extent of 2.000 hectares in Sy.No.80/1 of Kothamolgara Village, Boothpur Mandal, Mahabubnagar District, during the subsistence of valid quarry lease granted by the Dy. Director of Mines and Geology in proceedings No.4678/Q-III/2006, dt.07.04.2007 as arbitrary, illegal, unjust and unconstitutional and in violation of Mines and Minerals (Development & Regulation) Act 1957 and A.P. Minor Mineral Concession Rules 1966 as adopted by the Respondent No.2 in G.O.Ms.No.55, Industries & Commerce (M.II) Department, dated 26.08.2015, and to grant such other relief or reliefs as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Smt. P. Vijaya Lakshmi, learned counsel representing Sri K.K. Karuna Sagar, learned counsel for the petitioner, stated that the demand notice issued against the petitioner has been subjected to challenge by way of a revision before the State Government and the revisionary authority granted stay of further proceedings pursuant to the demand notice pending the disposal of the revision. This order seems to have been passed sometime in March, 2016. Learned Assistant Government Pleader for Mines and Geology, on instructions, informed this Court that in the light of the stay granted by the revisionary authority, the mining authorities would now issue dispatch permits to the petitioner in accordance with the due procedure.

In the light of the afore-stated submission, the cause in this writ petition does not survive for consideration.

The writ petition is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 11th April, 2016 IBL
