UMA DEVI Writ Petition No.28102 of 2017 Order: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The petitioner, a practicing Advocate from Nandyal Constituency, has filed this writ petition seeking a writ of mandamus to declare the action of the respondents in not acting in consonance with the norms stipulated for conducting free and fair elections in Nandyal Constituency, for the election scheduled to be held on 23.8.2017, as arbitrary and illegal. The petitioner is not a contestant in the election. His apprehension is that the election would not be conducted in a free and fair manner. The petitioner is not aggrieved by any action of the Election Commission of India or the Chief Electoral Officer of the State.

The writ petition is more in the nature of a public interest litigation. We see no reason, therefore, to entertain this writ petition. Suffice it to leave it open to the petitioner to avail the remedy of filing a Public Interest Litigation writ petition. This writ petition, however, fails and is, accordingly, dismissed.
