O R D E R
This writ petition is filed assailing the action of the Excise authorities in trying to shift the seventh respondent's shop. It is the admitted case of the petitioner that no order has been passed in this regard till date. It is only an apprehension of the petitioner that the authority concerned would pass orders permitting the shifting of the shop by the seventh respondent without looking into all the relevant facts.
This Court is of the opinion that no cause of action has arisen as yet for the petitioner to have filed this writ petition. Unless the authority concerned passes an order permitting the shifting of the shop by the seventh respondent, the petitioner can have no grievance and cannot assume that the authority would not consider all the relevant facts.
This writ petition is therefore premature and is accordingly dismissed. It would be open to the petitioner to approach this Court as and when a genuine cause of action arises.
Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
