The Hon'ble Sri Justice J.Sreenivas Rao Criminal Petition No.5073 of 2025 Order:

This Criminal Petition is filed to relax condition (ii), as imposed by the XIV Additional Chief Judicial Magistrate at Hyderabad vide order dated 11.03.2025 in Crl.M.P.No.258 of 2025, whereby the petitioner/accused No.1 and other accused were directed to appear before the Station House officer, Panjagutta Police Station, on every Sunday between 10:00 a.m. to 5:00 p.m. for a period of three months or till filing of charge sheet, whichever is earlier. 2.

Heard Mr. J.C.Francis, learned counsel for the petitioner/accused No.1 and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent-State. 3.

Learned counsel for the petitioner submitted that the petitioner along with other accused have filed Crl.M.P.No.258 of 2025 before the trial Court for grant of regular bail and the same was accordingly granted on 11.03.2025, with certain

conditions. He further submits that pursuant to the said order, the petitioner/accused No.1 has been appearing before the concerned Station House Officer on every Sunday between 10.00 a.m. to 5.00 p.m., but the petitioner being a practicing Advocate, is finding it very difficult to appear before the Station House Officer as per the order of the Court. Unless, the said condition is relaxed, the petitioner will be put to irreparable loss and great hardship.

Learned Additional Public Prosecutor submitted that the petitioner has complied with all the conditions imposed by the Court and is also appearing before the investigating officer as directed.

Having considered the rival submissions made by learned counsel for parties and after perusal of the material available on record, it reveals that it is not in dispute that the petitioner is a practicing Advocate and he had complied with all other conditions imposed by the trial Court while granting bail.

Even according to the learned Additional Public Prosecutor, as per the instructions of the Sub-Inspector of Police, Panjagutta Police Station, the petitioner is attending before the Station House Officer, Panjagutta Police Station, as per the orders of the Court and is co-operating with the investigating agency. 6.

In view of the same, condition (ii) as imposed by the XIV Additional Chief Judicial Magistrate at Hyderabad vide order dated 11.03.2025 in Crl.M.P.No.258 of 2025, is relaxed only in respect of petitioner/accused No.1. Except the said condition, the other conditions remain unaltered.

Accordingly, this Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any, pending in this petition stand closed.
